These General Terms and Conditions ("Terms") apply to all services provided by Helena FixIt Services ("Contractor," "we," "us," or "our"), a Limited Liability Corporation base in Lewis & Clark County, Montana, offering handyman services, home repairs, maintenance, and remodeling projects (including but not limited to bathrooms, kitchens, laundry rooms, and similar residential work) in the Helena, Montana area.

By requesting a quote, scheduling services, or accepting any work from us, the Client ("you" or "your") agrees to these Terms. These Terms may be supplemented by a specific quote, estimate, proposal, or written agreement for your project.

• The scope of work will be described in the written quote, estimate, proposal, or agreement provided to you ("Project Description").
• We will perform the services in a professional, workmanlike manner consistent with industry standards.
• Any changes to the scope must be agreed upon in writing via a Change Order, which may adjust the price, timeline, and other terms.
• We are not responsible for hidden conditions (e.g., mold, structural issues, termites, or code violations) discovered after work begins. If found, we will notify you immediately and propose a Change Order or cease work until resolved.

• Quotes and estimates are valid for [e.g., 30 days] from the date issued unless stated otherwise.
• Pricing includes labor, materials (unless specified as Owner-supplied), and applicable sales tax. Additional costs for unforeseen issues will be documented in a Change Order.
• Payment terms: [Customize based on your preference, e.g., 30-50% deposit upon acceptance for larger projects; balance due upon completion for small jobs; progress payments for remodeling.]
• Late payments incur a [e.g., 1.5%] monthly finance charge after [e.g., 10 days] past due.
• We reserve the right to place a mechanic's lien on the property for unpaid amounts, per Montana law.
• All payments are non-refundable except as provided in cancellation terms.

• We supply standard materials unless otherwise agreed.
• You are responsible for any special or Owner-supplied items.
• We are not responsible for defects in materials provided by you or third parties.

•  We provide a 1-year limited workmanship warranty on labor for defects in our installation (excludes normal wear, misuse, or modifications by others).
• Manufacturer warranties apply to materials/products.
• EXCEPT AS EXPRESSLY STATED, WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
• We are not liable for incidental, consequential, or indirect damages (e.g., loss of use, additional living expenses).
• Our total liability shall not exceed the amount paid for the specific services in question.

• You may cancel before work begins by written notice; deposits may be refunded minus any incurred costs (e.g., materials ordered).
• For ongoing projects, cancellation requires written notice and payment for completed work plus reasonable costs for demobilization.
• We may terminate or suspend work for non-payment, unsafe conditions, or material breach by you.

• You agree to provide safe access to the work area and remove pets, valuables, or obstacles as needed.
• You and occupants must maintain a safe distance from active work zones.
• You agree not to hold us liable for injuries resulting from failure to follow safety instructions.

• Any disputes shall first be addressed through good-faith negotiation.
• If unresolved, disputes shall be governed by Montana law and resolved in the courts of Lewis and Clark County, Montana.
• The prevailing party in any legal action is entitled to recover reasonable attorney fees and costs.

• These Terms, together with any specific quote or agreement, constitute the entire understanding.
• No verbal agreements modify these Terms.
• We may update these Terms; continued services after updates constitute acceptance.
• Force majeure: We are not liable for delays due to acts of God, strikes, supply shortages, or other events beyond control.
